  1. Terminology used in these Terms and Conditions

 

Us/We/Our = refers to Provence Guru

You = the consumer / the customer/Tour member

 

  1. Our responsibilities to you

 

Included in the price you pay for the tour we will provide:

7 nights accommodation at the 18th century Chateau Constantin wine estate, including daily clean of rooms

Each morning there will be a full French breakfast available, including croissants, baguettes, and pain au chocolat fresh from the village boulangerie. Accompanying jams and honeys will all be made locally.

All evening meals prepared by a local chef from fresh local ingredients. Please notify us of any special dietary requirements when booking.

All drinks (alcoholic and non alcoholic) while at the Chateau.

All daily excursions including transport and admission fees to sights and monuments.

Chilled mineral water on the bus during excursions.

Airport/TGV station transfer from/back to either Marseille Marignane airport or Avignon TGV.

 

All flight details must be advised prior to final payment for transfers to be arranged. The mode of transport will vary with the transfers dependent on the location and the number of clients traveling on the given transfer time and date. If you miss your transfer and decide to make your way to the accommodation no refund will be given for the transfer not undertaken.

Exclusions (not included in the price you pay for the tour):

–          international airfare to and from the tour.

–          transportation for optional activities and independent sightseeing during the tour is at the tour participant’s own cost,

–          On the final day of the tour our services finish after breakfast, when the transfers to the airport/TGV station will depart. No activities or overnight accommodation is included on the tour end date

 

4.Payment methods and currencies

 

Our tours are priced in US dollars (USD) and Euros because North America is our main market for our Provence tours.

We ask for payment by bank transfer in euros of the euro amount published on our website at the time of payment.

Booking a Tour

Your tour booking is not accepted or binding until the deposit has been paid.

The receipt by us of a deposit payment does not, by itself, constitute acceptance of a booking.

A booking will be deemed to have been accepted once the company has confirmed its acceptance in writing.

The balance of the tour price, being the total tour price less any deposits paid, must be paid 3 months before the tour start date, as published on our website.

Once the balance of the tour price has been paid the total amount paid by you to us is non-refundable. In the event of cancellation we will roll over the payment to a subsequent tour.

If you miss the final payment deadline this may result in you being removed from the tour.

Further details of arrangements for the tour will be communicated to you in the lead up to the tour.

 

  1. Flexible Pricing

 

We operate based on flexible pricing. This is the practice within the travel industry where prices can change due to a range of factors including, but not limited to, market conditions and spot specials. This can mean that different passengers on the same tour pay different prices for the same tour. We will not enter into any correspondence regarding any such variation in pricing. Our current pricing can be found on the Website.

 

  1. Our refund and credit policy

 

Deposits for tours are 100% refundable up to 3 months before the tour departure date, as published on our website.

All cancellations must be made in writing to us and sent via email to jamie@provenceguru.com

Cancelations will be effective as of date received.

 

  1. Cancelations by Provence Guru

 

Provence Guru tours are guaranteed tours. However in the highly unlikely of your tour may be cancelled by us due to unforeseen circumstances prior to the departure date the entire amount you have paid for the applicable tour will be refunded to you within fourteen days of the notified cancellation.

After this Provence Guru has no other obligations to tour participants on cancelled tours.

 

  1. Itinerary, accommodation and personnel changes and unused services

 

The published itinerary is not legally binding and may change depending on weather conditions and the interests of each group.

Refunds are not due for any uncompleted portions of the tour itinerary.

Provence Guru is not liable to refund tour participants the costs of any portion of services that are not used due to unforeseen circumstances or due to the tour participant deciding to opt out of a visit or activity on the day. This includes for reasons of ill health, jet lag or other personal issues.

Jamie Ivey is scheduled to accompany the tour each day. In the event of ill-health to Jamie or members of his immediate family Provence Guru reserves the right to substitute another appropriate tour leader for such time as necessary.

On the Creative Provence Experience Daniel Adel is scheduled to join the group on their return to the accommodation. In the event of ill-health to Daniel or members of his immediate family Provence Guru reserves the right to substitute another artistic mentor for such time as necessary.

Provence Guru tours are guaranteed tours. In the event of 7 or less participants, Provence Guru reserves the right to provide alternative accommodation to the Chateau. Any substitute accommodation will be of the same comfort level.

 

  1. Solo Traveler Single Supplements

 

If you are a solo traveller and would like to be accommodated in a single room, this may be possible through the payment of a single supplement fee.

The amount of the single supplement varies depending on the tour.

Single supplements are limited and based on availability, therefore not guaranteed.

 

  1. Free Time

 

It is acknowledged that we have no responsibility or liability whatsoever when you are absent from supervised or non-supervised activities, including but not limited to, any pre or post arrangements and any free time throughout the tour.

 

  1. Packing Policy

 

There is  no porterage at our accommodation so be aware that you will be responsible for getting your own bags to your room and to the bus/coach upon departure.

This may occasionally mean carrying bags up several flights of stairs. Where possible we will arrange for assistance, particularly if requested in advance.

 

  1. Physical demands of the tour

 

Provence Guru Tours are not overly physically demanding.

However to get the most of the experience, you should be in reasonably good shape.

Our most active days average 3 to 4 miles of walking (often around a city), there can be lots of standing while sightseeing, and climbing stairs.

 

  1. Non-smoking tour

 

As all our tours and the accommodation we use are non-smoking, any smokers wishing to join a tour may smoke only outdoors and downwind from the group.

You may never smoke in your room or during group activities or meals.

This includes electronic cigarettes, vaping, and cigars.

 

  1. Medical Conditions

 

To help keep you safe we request information regarding medical conditions or limitations and allergies, including food allergies.

We will hold this information in confidence but may be obliged to provide it, in the event of a medical emergency during the tour, to any attending care provider or emergency responder, should you be unable to communicate this information yourself.

This information will be kept confidential unless there is a medical emergency.

We request that you disclose prior to or at the time of the booking of a tour any adverse medical condition or pre-existing physical, mental, or emotional disability that may require attention or treatment during the tour.

This disclosure is important and relevant as it may affect any advice that we would seek to give you in relation to joining any proposed tour. It may also affect our willingness to accept your booking.

As our tours take place outside the USA, the Americans with Disabilities Act and other laws of the United States, individual states of the United States and their local jurisdictions, do not apply to our tours.

We do not provide any medical assistance or support on our tours.

All clients must satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen tour.

 

  1. Travel Insurance

Provence Guru strongly encourages all tour participants to purchase personal travel insurance prior to or at the time of booking a tour and to maintain this insurance for the duration of the tour.

We provide no travel insurance with the purchase of a tour and cannot provide legal advice as to the best companies to buy from.

Ideally you should purchase a policy that will provide indemnity to you for unlimited medical expenses, unlimited repatriation expenses, cancellation protection.

Other eventualities where travel insurance is invaluable include loss of luggage, trip delay, medical evacuation, personal liability for accidental damage to someone else’s property and more.

 

  1. Transportation Liability

 

Provence Guru acts only as an agent for transportation providers that we use during tours.

Although we take all care possible when sourcing providers and encourage good health and safety practise on tours, we can assume no liability for injury, damage, delay, loss, accident or irregularity in connection with the services of any airplane, boat, motor-coach, minibus, train, or other conveyance, public or private, used in the course of our tours.

We accept no responsibility for losses or additional expenses due to delay or changes in transportation services due to sickness, weather, strike, war, quarantine, acts of God or other causes beyond our control.

All such losses and expenses will have to be borne by the tour participant, as tour rates provide for arrangements only for the time stated.

Provence Guru does not accept liability for any airline cancellation penalty or change fee incurred by the purchase of non-refundable tickets to or from the tour.

 

  1. Accommodation Liability

 

Provence Guru acts only as an agent for accommodation providers that we use during tours.

Although we take all care possible when sourcing accommodation providers, we can assume no liability for injury, damage, delay, loss, accident or irregularity in connection with any accommodation.

 

  1. Acceptance of Risk.

 

By participating in a Provence Guru Tour you acknowledge that the tour may involve personal risk, such risks to include illness, injury, disease, loss or damage to property, discomfort and inconvenience.

You accept that this is the nature of international travel and you choose to participate. In making the booking you accept risk and agree that you are joining the tour upon condition of traveling at your own risk.

In agreeing to these terms and conditions you agree that you shall not make any claim against Provence Guru for injury or loss, howsoever caused, arising out of the acceptance of such risk.

It is your responsibility to be informed about any travel advisories or warnings issued by any Government Department.

If a travel advisory or warning is issued by a Government Department in relation to a destination on your tour, then you may, at your own discretion, cancel the booking (and in which case the cancellation policy as outlined in these terms and conditions will apply) or you may decide to proceed with the tour.

If you decide to proceed with the tour, you acknowledge and agree that you have decided to do so at your own risk and will not make any claims against Provence Guru in relation to any matters arising from this.

 

  1. Participation

 

We want everyone to have a good time on tour, however, if a tour participant misbehaves or does things that are incompatible with the safety, comfort or convenience of other tour participants, you agree that in those circumstances we have the exclusive right and discretion, to expel that person (even if it is you) from a tour at any time, without any claims or complaints by you against us.

We also reserve the right to decline to accept any person as a participant in our tours.

 

  1. Misprints

 

Provence Guru reserves the right to amend typos and misprints in pricing and other trip information.

 

  1. Data Protection

 

All customer data collected when you sign up for a tour (name, address, email address, passport information, date of birth) is handled sensitively.

We endeavour to the best of our abilities to protect any and all personal information you share with us over the course of making tour reservations.

If you have any concerns over these details being held or wish for your details to be wiped from our database after the tour email Jamie@provenceguru.com

 

  1. Force Majeure.

 

In the event of a Force Majeure Event, we  will undertake to make other arrangements to continue the tour in a manner that can be best arranged or in the Provence Guru’s sole discretion. The Itinerary may be changed as we consider necessary without incurring any liability to you. You acknowledge that a Force Majeure Event may result in a cancellation of any proposed or planned tours or continuation of the proposed tour. If travel is not possible due to flooding, arrangements will be attempted to be made to continue the tour as best as can be arranged, by other means. It is also acknowledged by you that the tour may not be able to be provided as advertised and we will use our best endeavors to make alternative arrangements regarding Itinerary, travel and accommodation.

  1.      Governing Law. This Agreement shall be deemed to have been entered into and shall be construed and enforced in accordance with the laws of England and Wales.
  2.     Mandatory Binding Arbitration.  You agree that any dispute concerning, relating or referring to this Agreement, advertising materials related to my tour, other literature concerning my tour, interactions with us concerning the tour or the tour itself, shall be resolved exclusively by binding arbitration. A non–prevailing Party shall reimburse a prevailing Party’s legal and arbitration fees and expenses.
  3. Publicity Materials.  We make no representation or warranty about the accuracy of the tour information contained in our publicity materials and exclude all liabilities for any errors or omissions in those materials. It is the passenger’s responsibility to check material prior to booking.
  4.     Legal Fees and Costs. In any action to enforce this Agreement, the prevailing Party will be entitled to costs and attorney’s fees.
  5.     Severability.  In the event that any of these terms and conditions are held by a court or other tribunal of competent jurisdiction (including during arbitration) to be illegal or unenforceable, those provisions shall be limited or eliminated to the minimum extent necessary so that these T&Cs shall otherwise remain in full force and effect.
  6. Entire Agreement, Modification and Updates to T&Cs. The Terms and Conditions in the Agreement constitute the entire agreement between you and Provence Guru pertaining to the subject matter hereof. In our sole discretion, we may modify and change the terms and conditions by posting a revised version of this Agreement on our Website or by notifying you in writing. Upon your written request we will provide you with a hard copy version of the Agreement. You will be bound by the terms and conditions in place on the day you receive confirmation of your booking and pay the required deposit.
  7. Electronic Contracting and Notices. Your affirmative act of using this Website or purchasing Services constitutes your electronic signature to this Agreement, and your consent to enter into agreements with us electronically.
  8. Waiver and Construction.  Our failure to enforce any provision of this Agreement shall not be deemed a waiver of future enforcement of that or any other provision.
